M.G.K. Inc. (the “Company”) sets out the following privacy policy (the “Policy”) for the handling of privacy information in the services (the “Services”) provided on this website (https://hawaii-kau.com/, the “Site”).
Article 1 (Privacy information)
- “Personal information” means “personal information” as defined in Japan’s Act on the Protection of Personal Information: information about a living individual that can identify a specific individual by the name, date of birth, address, telephone number, contact details or other descriptions it contains.
- “History and characteristic information” means privacy information other than the personal information defined above, such as the services used or products purchased, the pages and advertisements viewed, search keywords entered, the date, time, method and environment of use, postal code, gender, occupation, age, IP address, cookie information, location information, and device identifiers.
Article 2 (How privacy information is collected)
- The Company may ask users for personal information such as name, date of birth, address, telephone number, email address, bank account number, credit card number and driver’s license number when they register to use the Services. The Company may also collect, from its business partners (including information providers, advertisers and advertising distributors; “Partners”), transaction records containing users’ personal information and payment information relating to transactions between users and Partners.
- The Company collects history and characteristic information about users, such as the services and software used, products purchased, pages and advertisements viewed, search keywords, date and time of use, method of use, usage environment (including, for mobile devices, the device’s communication status and settings), IP address, cookie information, location information and device identifiers, when users use the services of the Company or its Partners or view their pages.
Article 3 (Purposes of collecting and using personal information)
The Company collects and uses personal information for the following purposes:
- To display registration information such as name, address, contact details and payment method, together with the services used, products purchased and their charges, so that users can view and edit their registration information and check their usage
- To use email addresses to send notices and contact users, and to use contact information such as name and address to ship products and contact users as needed
- To verify users’ identity using information such as name, date of birth, address, telephone number, bank account number, credit card number, driver’s license number and the delivery results of certified mail
- To bill users using payment-related information such as the names and quantities of products purchased, the type, period and number of services used, the amount billed, name, address, bank account number and credit card number
- To display information registered with the Company on input screens, or to transfer it to other services (including those provided by Partners) at the user’s instruction, so that users can enter data easily
- To use information on usage patterns and information that identifies individuals, such as name and address, in order to refuse service to users who breach the terms of use of the Services (for example by delaying payment or causing damage to third parties) or who attempt to use the Services for improper or wrongful purposes
- To respond to inquiries from users, using information the Company needs in order to provide the Services, such as the content of the inquiry and billing information, as well as the user’s usage status and contact information
- Purposes incidental to those above
Article 4 (Provision of personal information to third parties)
- The Company will not provide personal information to third parties without the user’s prior consent, except in the following cases and where otherwise permitted by the Act on the Protection of Personal Information or other laws:
- Where required by law
- Where necessary to protect a person’s life, body or property and it is difficult to obtain the person’s consent
- Where particularly necessary to improve public health or promote the sound growth of children and it is difficult to obtain the person’s consent
- Where necessary to cooperate with a national government organ, a local government, or a party entrusted by either of them in carrying out duties prescribed by law, and obtaining the person’s consent would be likely to impede those duties
- Where the following matters have been announced or published in advance:
- That the purposes of use include provision to third parties
- The items of data provided to third parties
- The means or method of provision to third parties
- That provision of personal information to third parties will be stopped at the person’s request
- Notwithstanding the preceding paragraph, the following are not regarded as provision to third parties:
- Where the Company entrusts all or part of the handling of personal information to another party within the scope necessary to achieve the purposes of use
- Where personal information is provided in connection with a business succession resulting from a merger or other cause
- Where personal information is used jointly with a specific party and the person has been notified in advance, or can readily learn, of that fact, the items of personal information used jointly, the scope of the parties using it jointly, their purposes of use, and the name of the person or organization responsible for managing the personal information
Article 5 (Disclosure of personal information)
- When a person asks the Company to disclose their personal information, the Company will disclose it without delay. However, the Company may decline to disclose all or part of it in any of the following cases, and will notify the person without delay if it decides not to disclose. A fee of JPY 1,000 per request is charged for the disclosure of personal information.
- Where disclosure is likely to harm the life, body, property or other rights or interests of the person or a third party
- Where disclosure is likely to seriously impede the proper conduct of the Company’s business
- Where disclosure would otherwise violate laws or regulations
- Notwithstanding the preceding paragraph, the Company will in principle not disclose information other than personal information, such as history and characteristic information.
Article 6 (Correction and deletion of personal information)
- If personal information about a user held by the Company is incorrect, the user may ask the Company to correct or delete it by following the procedure the Company specifies.
- If the Company receives such a request and decides that it needs to comply, it will correct or delete the personal information without delay and notify the user.
Article 7 (Suspension of use of personal information)
If a person asks the Company to suspend the use of, or erase, their personal information (together, “Suspension of Use”) on the grounds that it is being handled beyond the scope of the purposes of use or was obtained by improper means, the Company will carry out the necessary investigation without delay, suspend the use of the personal information based on the results, and notify the person. However, where Suspension of Use would involve a large expense or is otherwise difficult to carry out, and alternative measures can be taken to protect the person’s rights and interests, the Company will take those alternative measures.
Article 8 (Changes to this Policy)
- The Company may change the content of this Policy without notifying users.
- Unless the Company specifies otherwise, the revised Policy takes effect when it is posted on the Site.

Article 10 (Analytics tools and cookies)
- The Site uses Google Analytics 4, an analytics tool provided by Google LLC. Google Analytics uses cookies to collect traffic data. This data is collected anonymously and does not identify individuals.

- Users can refuse data collection by Google Analytics by disabling cookies in their browser settings or by installing the Google Analytics Opt-out Browser Add-on (https://tools.google.com/dlpage/gaoptout).
- The Site uses external services (embedded YouTube videos, and links to the online shop and the operating company’s website). Information handled by these external services is governed by each provider’s own privacy policy.
